Terms of Use

The short version

  • Spoondraw is a planning tool. It is not medical advice and not a substitute for a clinician.
  • It's a subscription, billed by Apple, and it renews until you cancel.
  • Cancel any time in your iPhone's Settings. Refunds go through Apple.
  • Don't try to break it or resell it, and we'll do our best to keep it working.

1. Who these terms are with

These terms are an agreement between you and Rhys Trevethan, a sole trader based in Australia, trading as Spoondraw ("we", "us"). They cover the Spoondraw iPhone app, this website, and the waitlist.

By using Spoondraw you're agreeing to them. If you don't, that's a fair choice — don't use it, and if you've just paid for it, see the refund section below.

2. Spoondraw is not medical advice

This matters more than anything else here, so it goes near the top.

Spoondraw helps you plan a day around the energy you tell it you have. It does not diagnose, treat, cure or prevent any condition. It is not a medical device, it is not monitoring your health, and the number of spoons it shows you is not a clinical measurement of anything.

Never use Spoondraw in place of advice from a qualified health professional, and never delay getting help because of something the app did or didn't put on your list. You know your own body and circumstances; the app doesn't. If you're in crisis, contact your local emergency services or a crisis line — in Australia, Lifeline is 13 11 14.

3. The licence to use the app

The Spoondraw app is licensed to you, not sold. Your licence is Apple's Standard End User Licence Agreement (EULA), which applies to apps distributed through the App Store. These Terms of Use sit alongside it and cover the things it doesn't — the subscription, the website, and the disclaimers here. Where the two genuinely conflict on the licence itself, Apple's EULA wins.

In plain terms: you get a personal, non-transferable licence to use Spoondraw on devices you own or control, for as long as these terms are respected.

4. Subscriptions and billing

Spoondraw is offered as an auto-renewing subscription, purchased through the App Store.

  • Apple takes the payment. Your subscription is charged to your Apple Account, not to us, and we never handle your card details.
  • Prices are shown in the App Store before you buy, in your own currency and including any local tax. We don't publish prices on this website because they vary by region — the App Store is the accurate source.
  • It renews automatically. Your subscription renews for another period unless you cancel at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before the period rolls over.
  • Cancelling is done through Apple, at any time: Settings → your name → Subscriptions → Spoondraw → Cancel Subscription. You keep full access until the end of the period you've already paid for.
  • Managing or changing a plan happens in the same place.

If a subscription lapses, your tasks are not deleted. They stay on your device, and they're there waiting if you subscribe again.

5. Refunds

Purchases through the App Store are refunded by Apple, not by us — we have no ability to issue one. Request a refund at reportaproblem.apple.com.

Nothing in these terms limits your rights under the Australian Consumer Law, or the equivalent consumer protection law where you live. Those rights apply regardless of what this page says.

6. Your data and your tasks

What you write in Spoondraw is yours. We don't claim any ownership of it, and as the Privacy Policy explains, it stays on your device rather than coming to us.

The flip side of that: backing it up is your responsibility. Because we hold no copy, we cannot restore your tasks if you delete the app, lose your phone, or turn off iCloud. Keep device backups on if that data matters to you.

7. Using it reasonably

Please don't reverse-engineer, decompile or tamper with the app, try to get around the subscription, resell or sublicense access, or use Spoondraw to do something illegal. If you do, we may end your licence — though in practice we'd rather just talk to you.

8. Availability, and things breaking

We'll make a genuine effort to keep Spoondraw working and to fix what's broken, but we can't promise it will be available without interruption or completely free of bugs. Features may change, and occasionally something may be removed — if that affects how you use the app, we'll say so rather than letting you discover it.

Spoondraw is provided "as is". To the extent the law allows, we're not liable for indirect or consequential loss arising from using it. Where liability can't be excluded, it's limited to what you paid us in the previous 12 months — which for most people is the cost of a few months' subscription. Again, this doesn't cut across consumer guarantees that apply to you by law.

9. The waitlist and this website

Joining the waitlist means you're asking us to email you about Spoondraw. It doesn't commit you to buying anything and it doesn't commit us to a release date. Unsubscribe whenever you like — the link is in every email.

The content of this site, including the Spoondraw name, wording and design, belongs to us. Screenshots and normal quoting for review, press or discussion are fine and welcome.

10. Changes to these terms

We may update these terms as the app changes. The date at the top will move, and if a change materially affects you we'll tell you in the app rather than relying on you to re-read this page. Continuing to use Spoondraw after a change means you accept it.

11. Governing law

These terms are governed by the laws of Australia. If we end up in a dispute we can't resolve by talking, the courts of Australia have jurisdiction — without affecting any right you have to bring a matter in your own country of residence.
